Yayin Terms of Use
Effective date: October 15, 2026 · Contact: info@yayin.ai
These Terms describe the rules for using Yayin, including eligibility, accounts, AI recommendations, the photos and reviews you submit, community content, and your responsibilities when using the service.
Operator and Acceptance of Terms
Yayin (the "App") is an AI wine assistant. It helps you pair wine and food, choose from restaurant menus and wine lists, plan wines for an occasion, and keep track of the wines you own, taste, and want to try.
The App, the website at yayin.ai, and all associated services (together, the "Services") are operated by Sealsync.ai ("Sealsync", "we", "us", "our"). The formal operating entity is SealSyncAI Inc. (the "Company"), with a notice address at 6 Liberty Square #2634, Boston, MA 02109, United States.
These Terms of Use (the "Terms") govern your access to and use of the Services. You agree to these Terms and to our Privacy Policy, available at yayin.ai/privacy, when you do any of the following:
- create an account;
- scan a wine, dish, menu, or wine list;
- submit content;
- otherwise use any part of Yayin.
You also agree to use the Services only in a lawful, responsible, and good-faith manner. If you do not agree with these Terms, do not use Yayin.
We may revise these Terms from time to time, as described in "Changes and Contact." The current version always shows its effective date.
Important Notice – Please Read Carefully
Yayin is a consumer information tool about wine and food. Its recommendations are general and indicative, are generated with the help of AI, and are provided "as is." We do not guarantee that they are accurate, complete, or suitable for you.
- Age: Yayin is intended only for adults of legal drinking age where they live, and never for anyone under 21 in the United States.
- Alcohol sales: Yayin does not sell, deliver, or serve alcohol. Nothing in the App is an offer or an encouragement to buy or drink alcohol. Drink responsibly, never drink and drive, and follow the laws where you are.
- Health: Yayin does not provide medical, nutritional, or health advice. If you are pregnant or breastfeeding, take medication, or have a health condition, ask a qualified professional whether and how much alcohol is safe for you.
- Allergens: dish suggestions, ingredient lists, and menu analyses may be wrong or incomplete. If you have a food allergy or intolerance, always confirm ingredients with the restaurant or on the product packaging, and do not rely on Yayin.
You use the App at your own risk and under your sole responsibility.
Definitions
The following terms are used throughout these Terms:
- App / Yayin: the Yayin mobile application for iOS and Android, the website at yayin.ai, and all their pages and screens.
- Services: the recognition, pairing, recommendation, occasion planning, cellar, tasting journal, wishlist, community, and related features Yayin provides.
- User / you: any person who uses the Services.
- Recommendations: the outputs the Services generate. These include pairings, wine and dish suggestions, occasion plans, fit labels, taste-match percentages, tips, and explanations.
- Taste Profile: the preferences learned from your taste quiz answers, ratings, and activity, and used to personalize Recommendations.
- User Content: the photos, text, ratings, reviews, tasting notes, and other content you submit to the Services.
- Community Content: the ratings, reviews, and wine label photos that may be visible to other users.
- Wine Data: information about wines, such as producers, vintages, regions, grapes, styles, prices, drinking windows, and images.
- Data Sources: the public sources, web search, third-party providers, and user contributions from which Wine Data is drawn.
- Store: the platform through which the App is distributed, namely the Apple App Store or the Google Play Store.
Eligibility
To use Yayin, you must:
- be of legal drinking age in the place where you live, and at least 21 years old if you are in the United States;
- be able to form a binding contract.
By using the Services, you confirm that you meet these requirements. You may not use Yayin where its content is prohibited by local law. We may suspend or close any account that we reasonably believe belongs to someone who does not meet these requirements.
What Yayin Provides
- Wine to food: scan a wine label or type a wine's name to get dish pairings.
- Food to wine: photograph or describe a dish to get recommended wine styles, including wines from your cellar.
- Restaurant suggestions: photograph a menu or wine list to get ranked suggestions from the items listed on it.
- Occasion planning: describe an occasion and choose courses to get a multi-course plan with a wine for each course.
- Cellar, tasting journal, and wishlist: keep track of the wines you own, have tasted, and want to try, with insights about your cellar.
- Taste profile: a profile of your preferences that personalizes Recommendations and shows your progress.
- Community ratings and reviews: rate wines and read what other users think.
We may add, update, improve, suspend, or remove features over time. We may also set reasonable usage limits, for example on how often you can regenerate results or use AI features.
How Recommendations Work
How Yayin reaches a Recommendation:
- Recognition. When you scan a label, dish, menu, or wine list, or type a name, Yayin uses AI to recognize what is shown. It may ask you clarifying questions.
- Wine Data. We draw Wine Data from our catalog, public sources, and AI-assisted web search, and we may enrich it over time.
- Pairing. Recommendations combine general food and wine pairing principles with your Taste Profile and, where relevant, the wines in your cellar.
How to read the results:
- Fit labels (such as "Excellent," "Good," or "Interesting") and taste-match percentages are opinions based on the available data and your preferences.
- They are indicative only. They are not a judgment of a wine's or dish's quality, safety, or value, and they do not guarantee that you will enjoy it.
- Vintages, prices, price tiers, drinking windows, ratings, and availability are approximate and may be out of date.
Restaurant suggestions:
- They are limited to what we could read on the menu or wine list you photographed, and they depend on photo quality.
- Restaurants may change their items, ingredients, and prices without notice.
Personalization and Taste Profile
Recommendations are personalized to your Taste Profile. The profile is built from:
- your taste quiz answers;
- how you rate Recommendations;
- the suggestions you ask to replace;
- the wines you add to your cellar.
The more you rate, the better personalization usually becomes. You can retake the taste quiz at any time to reset your quiz answers. Personalization depends on the information available and may not always reflect your current tastes.
Use of AI
Yayin uses AI to:
- read wine labels, menus, and wine lists, and identify dishes;
- generate Recommendations and their explanations;
- write summaries, tips, and notification text;
- create illustrative dish images;
- translate content into your language.
AI outputs can vary between requests and may contain errors, omissions, or inaccurate descriptions. Illustrative dish images are generated automatically and may not look like the actual dish. Translations are machine-generated and may be imperfect.
To improve the Services, we may use wine and food content and de-identified information to develop and train AI models, as described in our Privacy Policy.
Privacy and Data Use
Our Privacy Policy explains:
- what information we collect and how we use it;
- how we use information to improve Yayin and train AI models;
- how we may use and share aggregated or de-identified information that does not identify you, including with business partners.
By using the Services, you acknowledge these practices.
Accounts
You need an account to use Yayin. You can sign up with an email address and password, or with Sign in with Apple or Sign in with Google.
- Keep your account information current and accurate to the best of your knowledge.
- Keep your login credentials secure and do not share them with other people.
- You are responsible for activity that occurs under your account, unless you notify us of unauthorized use without unreasonable delay.
Accounts created by bots or automated methods are not permitted. Each person may maintain only one account unless we expressly authorize otherwise.
You can delete your account in the App under Profile → User settings → Delete your account, or by contacting us. You then have 30 days to cancel the request. After that, your account is deleted as described in our Privacy Policy. We may suspend or terminate an account that violates these Terms.
Your Content and Visibility
You may submit User Content to the Services, including:
- photos of wine labels, bottles, dishes, menus, and wine lists;
- text such as queries, comments, and occasion descriptions;
- ratings, reviews, and tasting notes.
Visibility of your content:
- Ratings and written reviews of wines are public. They are shown with your name and profile photo, and your rating counts toward the wine's overall rating.
- Wine label and bottle photos may be shown to other users viewing the same wine and may be selected as that wine's main image. They may also become part of shared wine records.
- Everything else stays private. Other User Content, such as your Taste Profile, history, cellar, tasting journal, and wishlist, is not shown to other users, as described in our Privacy Policy.
Your license to us. You keep any ownership rights you have in your User Content. By submitting it, you grant Sealsync a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, store, reproduce, modify, display, distribute, and create derivative works from that content. This license covers operating, improving, and developing Yayin and our other products and services, including training and evaluating AI models. Our Privacy Policy governs how we handle any personal information within your User Content.
Your responsibilities for what you submit:
- Submit only content you have the right to submit, and that does not violate the rights, privacy, or intellectual property of any third party.
- Photograph the wine, dish, menu, or wine list, and avoid capturing people or personal details.
- Do not submit unlawful, deceptive, or abusive material.
Reviews and Community Guidelines
When you rate or review a wine:
- Base your rating and review on your own genuine experience with that wine.
- Do not review a wine if you have a conflict of interest. For example, do not review it if you work for, own, or are paid by its producer, importer, distributor, or seller, or by a competitor.
- Do not post content that is offensive, hateful, harassing, sexually explicit, or defamatory.
- Do not post other people's personal information, advertising, spam, or links.
- Do not post content that promotes underage drinking, excessive drinking, or drinking and driving.
Reviews reflect the opinions of the users who post them, not our opinions. We do not monitor all Community Content and are not responsible for content posted by others. We may remove or hide Community Content, and restrict the ability to post it, where we reasonably believe these guidelines or these Terms have been breached.
Acceptable Use and Data Integrity
You agree not to:
- misuse Yayin or interfere with the Services;
- attempt unauthorized access, or probe or test the platform's security;
- access the Services by any means other than the App or interfaces we provide;
- scrape or harvest data through automated means;
- reverse engineer the App;
- circumvent usage limits;
- try to manipulate our AI features, for example by entering instructions designed to override how they work or to reveal their underlying instructions;
- use Recommendations or Wine Data to build a competing product or dataset;
- upload malicious code;
- use the Services in a way that harms other users or the operation of the App.
You also agree to contribute honestly. Deliberately submitting false or misleading content undermines the integrity of the Services and is a breach of these Terms. Examples include photos that do not show the wine or dish you are asking about, ratings that do not reflect your experience, and fake reviews.
We may restrict, suspend, or terminate access where we reasonably believe a user:
- is abusing the Services;
- is submitting deliberately false content;
- is violating these Terms;
- is creating legal or operational risk for Yayin or other users.
Alcohol, Health, and Food Information
Yayin is not a medical application and does not provide medical, nutritional, or health advice. Recommendations, Wine Data, dish descriptions, ingredient lists, and other outputs are informational only. They are provided on an "as is" and "as available" basis, without warranties of any kind.
- Yayin does not sell or deliver alcohol, and we are not responsible for purchases you make from third parties. Prices shown are estimates.
- Consume alcohol responsibly and in accordance with the law. Never drive or operate machinery after drinking.
- If you are pregnant or breastfeeding, take medication, or have a health condition, seek professional advice before drinking alcohol. Never disregard professional advice because of something you read in the App.
- Always confirm ingredients and allergens with the restaurant or on the product packaging. People with food allergies or intolerances must not rely on Yayin's dish suggestions or ingredient information.
- Drinking windows and storage guidance are general estimates, and we are not responsible for the condition of your wines.
Third-Party Content and Services
- Third-party sources. Some Wine Data, images, and reviews come from third-party sources. That content belongs to its respective owners and may be inaccurate, and showing it does not mean we endorse it.
- Trademarks. Wine names, producer names, labels, and other trademarks are shown only to identify wines. Showing them does not imply any affiliation with, or endorsement by, their owners.
- Third-party services. If you sign in with Apple or Google, your use of those services is also subject to their terms.
Notifications and Communications
Yayin may send you push notifications, such as rating reminders, wine tips, reminders when you have not used the App for a while, and service announcements. You can turn push notifications off at any time in your device settings.
We send service emails needed to operate your account, such as password recovery. We send marketing emails only if you opted in.
Fees
Yayin's features are currently free.
If we introduce paid features or subscriptions:
- They will be offered through the Store under its terms.
- We will show the price and conditions before you buy, and you will never be charged without making an explicit purchase.
- Billing, renewal, cancellation, and refunds will be handled by the relevant Store under its own terms and your statutory consumer rights.
Limitation of Liability and Warranty Disclaimer
To the fullest extent permitted by law, the Services and all Recommendations, Wine Data, Community Content, and other outputs are provided "as is" and "as available," without warranties of any kind, whether express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
To the fullest extent permitted by law, Yayin and Sealsync are not liable for losses, decisions, or outcomes arising from reliance on Recommendations, Wine Data, Community Content, or AI outputs. This includes:
- decisions about what to buy, order, eat, or drink;
- allergic reactions;
- the effects of consuming alcohol;
- inaccurate menus or labels;
- outdated information.
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data. To the extent liability cannot be fully excluded, our aggregate liability is limited to the greater of:
- the amount you paid us for the Services in the twelve months before the claim;
- US$50.
Nothing in these Terms is intended to exclude or limit rights that cannot lawfully be excluded under applicable consumer-protection law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Sealsync, the Company, and their affiliates and personnel from any claims, damages, and expenses, including reasonable legal fees, arising from:
- your User Content;
- your violation of these Terms or of applicable law;
- your misuse of the Services.
Intellectual Property
The Yayin name, logos, software, recommendation and matching methods, and the look and feel of the App are owned by Sealsync or its licensors.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. These Terms do not transfer any intellectual property rights to you. You may not access or reuse the source code, methods, or algorithms behind the Services, and you may not copy, modify, distribute, sell, or lease any part of them.
Third-party trademarks, brands, wine labels, images, and texts shown in the App for informational purposes remain the property of their respective owners.
Termination
You may stop using Yayin at any time and delete your account as described in "Accounts." We may suspend or terminate your access as described in these Terms.
These sections survive termination:
- the license you grant in "Your Content and Visibility";
- the disclaimers and limitations of liability;
- indemnification;
- governing law and dispute resolution.
Apple App Store Terms
If you downloaded the App from the Apple App Store, the following also applies:
- These Terms are between you and the Company, not Apple. The Company, not Apple, is solely responsible for the App and its content.
- Your license to use the App is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- The Company, not Apple, is responsible for addressing any claims relating to the App. These include product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
- If a third party claims that the App infringes its intellectual property rights, the Company, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country. You also confirm that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the App, such as the terms of your wireless data service.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the state in which the Company is established, without regard to its conflict-of-laws rules.
Informal resolution first. Before starting any formal proceeding, you agree to give us an opportunity to resolve the dispute. Send a written notice describing the dispute and your proposed resolution to info@yayin.ai or to 6 Liberty Square #2634, Boston, MA 02109, United States, and we will try in good faith to resolve it. If it is not resolved within 60 days, either party may proceed as set out below.
Binding individual arbitration. Except where prohibited by law, any dispute that is not resolved informally will be settled by binding individual arbitration rather than in court. The arbitration will be administered under the rules of a recognized U.S. arbitration provider and seated in the state in which the Company is established. You and we waive the right to a jury trial. We both agree that disputes will be brought only in an individual capacity, and not as part of any class or representative action (the "class-action waiver").
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms. To do so, send written notice of your decision to info@yayin.ai or to 6 Liberty Square #2634, Boston, MA 02109, United States. Opting out will not affect your use of the Services.
If applicable law does not permit binding arbitration or the class-action waiver to apply to you, those provisions apply to the fullest extent permitted by law. Any matters not subject to arbitration will be heard in the state or federal courts located in the state in which the Company is established.
Consumers in the EEA, UK, and Switzerland. If you are a consumer living in the European Economic Area, the United Kingdom, or Switzerland, the arbitration agreement and class-action waiver do not apply to you. You keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of your country.
These dispute-resolution terms apply to the fullest extent permitted by applicable law.
Changes and Contact
We may update these Terms from time to time. When we do, we will publish the revised version with a new effective date. If we make material changes, we will notify you in the App or by email before they take effect. Your continued use of the Services after an update means you accept the revised Terms.
